HIPAA Compliance

Business Associate Agreement (BAA)

CustomBrain.ai enters into BAAs with all covered entities to ensure compliance with HIPAA regulations. The BAA outlines the responsibilities of each party to protect PHI and includes the following provisions:

  • Permitted Uses and Disclosures: Clear description of the uses and disclosures of PHI that the business associate is permitted or required to make.
  • Safeguards: Assurance that appropriate safeguards are in place to prevent unauthorized use or disclosure of PHI.
  • Reporting: Obligation to report any use or disclosure of PHI not provided for by the BAA.
  • Subcontractors: Requirement to ensure that any subcontractors agree to the same restrictions and conditions with respect to PHI.
  • Access to PHI: Provision for individuals to access their PHI and make amendments to it.
  • Accounting of Disclosures: Provision for individuals to receive an accounting of disclosures of their PHI.
  • Termination: Conditions under which the BAA can be terminated and the actions required upon termination, including the return or destruction of PHI.

Client and User Responsibilities

Clients and users of CustomBrain.ai services must also comply with HIPAA regulations. This includes, but is not limited to:

  • Ensuring that any PHI provided to CustomBrain.ai is accurate and necessary for the intended purpose.
  • Promptly reporting any suspected or actual breaches of PHI.
  • Complying with all applicable laws and regulations regarding the use and disclosure of PHI.
